지방세 납세자보호관 제도란? 과세관청의 위법‧부당한 처분을 납세자 입장에서 해결하거나 납세와 관련하여 어려움이 있는 납세자에게 도움을 주는 제도입니다.
1. 처리업무
❍ 처분이 완료된 사항으로 위법·부당한 처분 및 권리 침해된 고충민원
❍ 처분이 완료되기 전 사항으로 법령위반이나 재량남용 등으로 권리가 침해되거나 현저히 예상되는 권리보호요청 민원
❍ 세무조사 기간연장(연기) 및 가산세 감면, 징수유예 등에 대한 사항
2. 제외대상
❍ 지방세관계법이나 타 법률 등에 따른 불복절차가 진행 중이거나 결정이 완료되어 확정된 사항
❍ 탈세정보 등 지방세 관련 고소·고발 사건
❍ 지방세기본법 등에 따른 불복절차 및 과세전적부심사 청구기간이 지나지 아니한 사항과 소송이 진행 중인 사항 등
3. 신청 및 처리절차
❍ 고충민원
– 부과 제척기간 종료일 90일 이전까지 신청(별지 1호)
– 접수일로부터 14일 이내 처리 후 회신(1회 30일 이내 연장가능)
❍ 권리보호요청
– 부과 제척기간 만료일 6개월 이전까지 신청(별지 20호)
– 접수일로부터 7일 이내 처리 후 회신(1회 14일 이내 연장가능)
4. 기 타
❍ 민원신청서를 작성하여 울산 남구 납세자보호관에게 신청
(민원신청서로 접수함이 원칙이나, 특별한 경우 구술 등 다른 방법으로 가능)
